1. MEMBERSHIP AGREEMENT

  • This Membership Agreement is between The Naari (operated by THE W LONGEVITY CLUB PRIVATE LIMITED, Surat, Gujarat, India) and the approved member.
  • By activating membership, the member agrees to abide by all rules, policies, and operational guidelines of The Naari.
  • Membership is personal, non-transferable, and cannot be shared or assigned.
  • The Naari reserves the right to approve, decline, suspend, or terminate membership to protect the safety, privacy, and experience of its members.

2. MEMBERSHIP ELIGIBILITY

  • Membership is intended for women and those who identify as women in accordance with the women-first philosophy of the centre.
  • Applicants must be 18 years or older. Minors may access certain services only with parental or guardian consent and where permitted by service protocols.

3. MEMBERSHIP FEES & PAYMENTS

  • All membership fees must be paid in advance unless otherwise stated.
  • Prices may include or exclude applicable GST as per Indian taxation laws.
  • Membership becomes active only after successful payment confirmation.
  • Membership fees once activated are generally non-refundable except during a 72‑hour cooling-off period provided no services have been used.

4. MEMBERSHIP BENEFITS

  • Benefits, credits, services, and privileges depend on the selected membership tier.
  • Unused credits expire at the end of the membership period unless otherwise specified.
  • The Naari may revise benefits periodically while maintaining the integrity of the membership program.

5. CODE OF CONDUCT

  • Members must respect the privacy and dignity of other members and staff.
  • Harassment, discrimination, disruptive behaviour, solicitation, or violation of privacy rules may result in immediate suspension or termination without refund.
  • Photography, videography, or recording inside the centre is strictly prohibited unless authorised in writing.

6. HEALTH DISCLOSURE

  • Members must provide accurate medical information where required for safe service delivery.
  • Members should inform clinicians of pregnancy, ongoing medical treatment, allergies, or health conditions before undergoing any service.

7. CLINICAL SERVICES DISCLAIMER

  • Medical services are delivered by licensed professionals according to Indian medical guidelines.
  • No specific treatment outcome is guaranteed.
  • Wellness services such as spa, nutrition, or lifestyle coaching are not substitutes for medical treatment unless delivered by a qualified healthcare professional.

8. MEDICAL EMERGENCIES

  • The Naari is not designed as a 24-hour emergency medical facility.
  • In case of emergencies, members may be stabilised and referred to an appropriate hospital or emergency facility.

9. PRIVACY INSIDE THE CENTRE

  • CCTV monitoring may be installed in reception areas, entry points, and security zones only.
  • No surveillance exists inside consultation rooms, therapy rooms, spa areas, or washrooms.

10. DATA PRIVACY

  • The Naari collects only essential information required for membership management and service delivery.
  • This policy follows the Information Technology Act 2000 and the Digital Personal Data Protection Act 2023.
  • Personal and health information is treated as confidential and accessed only by authorised staff.

11. DATA USAGE

Data may be used for:

  • appointment scheduling
  • membership management
  • service delivery
  • communication and support
  • regulatory compliance
  • operational improvement

Personal data will never be sold to third parties.

12. DATA STORAGE

  • Information may be stored securely on encrypted systems or compliant cloud servers located in India or other legally permitted jurisdictions.

13. COMMUNICATION

  • Members may receive service reminders, operational updates, and centre announcements via email, phone, WhatsApp, or SMS.
  • Members may opt out of marketing communications at any time.

14. INTELLECTUAL PROPERTY

  • All branding, designs, photographs, written materials, and digital content belong exclusively to The Naari.
  • Unauthorised reproduction or commercial use is prohibited.

15. LIMITATION OF LIABILITY

  • To the maximum extent permitted by law, The Naari shall not be liable for indirect, incidental, or consequential damages.
  • Total liability shall not exceed the amount paid for the specific service in question.

16. INDEMNITY

  • Members agree to indemnify and hold harmless The Naari, its directors, clinicians, employees, and partners from claims arising due to misuse of services, inaccurate health information provided by the member, or violation of these terms.

17. TERMINATION OF MEMBERSHIP

  • The Naari may terminate membership in cases of policy violations, safety concerns, misuse of facilities, or non-payment of dues.

18. FORCE MAJEURE

  • The Naari shall not be responsible for service interruptions caused by events beyond reasonable control including natural disasters, government restrictions, strikes, or infrastructure failure.

19. GOVERNING LAW

  • This agreement shall be governed by the laws of India.
  • Courts in Surat, Gujarat shall have jurisdiction over disputes arising from this agreement.
